How Do I Look Up Warrants in West Virginia?
WestVirginiaCourts.us is not a consumer reporting agency as defined by the FCRA and does not provide consumer reports. All searches conducted on WestVirginiaCourts.us are subject to the Terms of Service and Privacy Notice.
You can use WestVirginiaCourts.us to locate a warrant in West Virginia, as it compiles publicly available information reported by West Virginia's courts and law enforcement agencies into a single search. A search can reveal the warrant type, issuing court, case number, alleged offense, and bail or bond amount, when available.
West Virginia splits its judicial workload between circuit courts and magistrate courts across all 55 counties. Circuit courts handle felonies and civil cases above certain thresholds; magistrate courts process misdemeanors, preliminary felony hearings, and emergency protective orders. Each tier maintains its own record system. The state judiciary has launched separate online search tools for each — one for circuit court records, another for magistrate court records — but neither is designed as a warrant index, and neither cross-references the other. A person checking records in Kanawha County's circuit court system would miss a warrant issued out of the same county's magistrate court, and there is no unified query that spans both.
That two-track structure, multiplied across 55 counties, creates a maze of records that resists quick, comprehensive checking. A single-search tool that draws from available public data across jurisdictions eliminates the need to navigate each system individually.
Are Warrants Public Information in West Virginia?
West Virginia's Freedom of Information Act (W.Va. Code § 29B-1-1 et seq.) establishes a presumption of public access to all government records, including court filings and law enforcement documents. Under § 29B-1-3(d), a custodian who receives a records request must respond within five business days — either by producing the records, setting a time for inspection, or issuing a written denial with reasons.
Arrest warrants and bench warrants (called "capiases" in West Virginia practice) are part of the court record once filed and are accessible to the public. Bench warrants arising from failures to appear under W.Va. Code § 62-1C-17b are docketed in the originating case and surface in both the circuit and magistrate court search systems, depending on where the case was filed.
Search warrants fall into a different category. Section 29B-1-4(a)(4) exempts "records of law-enforcement agencies that deal with the detection and investigation of crime" from mandatory disclosure. Affidavits supporting search warrants routinely qualify for this exemption while an investigation is active. Even after the investigation concludes, the records may not appear in any online portal — they exist on paper at the issuing court, accessible only by request or visit.
The broader reality is that West Virginia's online court systems are case-lookup tools, not warrant databases. The West Virginia Public Access Search System (WVPASS) covers circuit court documents statewide back to 1999, and the Magistrate Case Record Search indexes magistrate court filings across all 55 counties. Both allow name-based searches. But a case listing that shows a charge does not always indicate whether an active warrant is attached — that detail may require a call to the clerk.
How to Search for a Warrant in West Virginia
- Use WestVirginiaCourts.us. Our Instant Warrant Lookup presents you with warrant record data compiled from available public resources in one convenient search. When available, you can find warrant type, issuing court, case number, alleged offense, and bail/bond amount, among other details, depending on the record type and issuing county.
- Search the state judiciary's online systems. West Virginia offers two free portals: WVPASS for circuit court records and the Magistrate Case Record Search for magistrate court filings. Both accept name-based queries and cover all 55 counties. WVPASS includes downloadable documents for registered users at a nominal fee; the magistrate search displays case summaries but does not provide documents online — those must be obtained from the clerk's office. Neither portal is a warrant-specific database, so results require interpretation.
- Call the county sheriff's office or magistrate clerk. Provide the subject's full legal name, date of birth, and the county where the case may have originated. West Virginia sheriffs' offices execute warrants issued by both circuit and magistrate courts, and many will confirm the existence of an active warrant by phone. Magistrate clerks can verify bench warrants on their dockets.
- Visit the courthouse or sheriff's office in person. In-person visits tend to produce faster and more complete results than phone or written requests. A person who appears at a law enforcement office to ask about a warrant issued in their own name may be arrested on that warrant.
- Retain an attorney. An attorney can contact the court or prosecutor's office to confirm whether a warrant exists, review its terms, and explore options such as a motion to quash or a voluntary surrender arrangement.
How Long Is a Warrant Active in West Virginia?
Arrest warrants and bench warrants do not expire in West Virginia — they remain enforceable until the person is apprehended, the warrant is recalled, or a court grants a motion to quash. Search warrants must be executed and returned within 10 days of issuance under W.Va. Code § 62-1A-4. What distinguishes West Virginia is its statutory treatment of bench warrants for failure to appear. Under § 62-1C-17b(i), where the record does not show that the defendant received effective notice of the court date or has no documented history of failing to appear, the court may not issue a capias until at least 24 hours have passed since the missed appearance — and if the defendant voluntarily appears within that 24-hour window, prosecution for failure to appear is barred entirely. Failure to appear on a felony case is itself a felony carrying up to five years in prison and a $5,000 fine; on a misdemeanor case, it is a misdemeanor with up to one year in jail and a $1,000 fine.
West Virginia Warrant Records by County
Warrants in West Virginia are issued and maintained at the county level. The state's 55 counties each operate a circuit court and a magistrate court, and the county sheriff's office is responsible for executing warrants from both. West Virginia has no centralized statewide warrant database available to the public — the judiciary's online tools (WVPASS and the Magistrate Case Record Search) index case records, not warrants specifically. To confirm whether a warrant exists, a search must be directed to the county where the case originated. The West Virginia Sheriffs' Association maintains a directory of all 55 county sheriffs.
