Are Court Records Public in Nicholas County?

West Virginia law starts from a broad presumption that court records are open to the public. The West Virginia Freedom of Information Act (W. Va. Code § 29B-1-1 et seq.) and Rule 10.04 of the West Virginia Rules of Judicial Administration together set the rules for what's open and what's shielded from disclosure.

Sixteenth Judicial Circuit — Nicholas County Circuit Court

The Nicholas County Circuit Court is the trial court of general jurisdiction for the Sixteenth Judicial Circuit, which covers only Nicholas County. Birth and Death Records

Birth and death records are managed by the Nicholas County Clerk for local certified copies, and by the West Virginia Department of Health for state-level requests. Birth records are confidential for 100 years from the date of birth; death records are confidential for 50 years from the date of death. Eligible requesters include the named individual (if 18 or older), immediate family members, legal guardians, and authorized representatives.

Certified copies cost $12.00 per copy whether you order through the state Certificate Requests portal or mail your request to the Vital Registration Office.
