Wyoming County, West Virginia, is a small but active jurisdiction in the state’s southern coalfields region, with its county seat located in Pineville. The county’s court system spans four distinct bodies — the Circuit Court, Magistrate Court, Family Court, and Probate division — each maintaining its own records and serving a defined range of legal matters. Whether you are tracking a civil dispute, researching a criminal case, or managing an estate, knowing which court holds the records you need is the essential first step.

Court records in West Virginia can be accessed through several channels depending on the type of case involved. WestVirginiaCourts.us can help you locate court case information across the state. The West Virginia Judiciary also maintains dedicated online search tools for both circuit and magistrate court records, described in detail below. In-person access is available at the respective clerk’s offices, and public access terminals at the courthouse allow on-site research without requiring a formal written request.

How to Look Up a Court Case in Wyoming County?

Wyoming County’s court records are split between two separate clerk’s offices depending on the type of case. The Circuit Clerk holds records for circuit and family court proceedings, while the Magistrate Clerk maintains records for magistrate court cases. Probate records are the responsibility of the County Clerk.

Online Search Options

The West Virginia Judiciary offers two free statewide search portals:

  • WVPASS (West Virginia Public Access Search System) — Launched in March 2025, this system provides online access to all publicly available circuit court documents dating back to 1999 across all 55 counties, including Wyoming County. Registration is free, and documents can be downloaded for a small fee.
  • Magistrate Case Record Search — This portal lets anyone search magistrate court case information statewide by entering a party name or case number. The system returns up to 30 records at a time and displays case histories for civil and criminal matters.

Both portals are accessible from the West Virginia Judiciary’s court record access page.

Are Court Records Public in Wyoming County?

West Virginia law presumes that court records are open to the public. The West Virginia Freedom of Information Act (FOIA), W.Va. Code § 29B-1-3, establishes that all public records — including judicial records — are accessible to citizens unless a specific statutory exemption applies. The burden falls on the government body, not the requester, to justify withholding a document.

Several well-defined categories of records are restricted from general public disclosure:

  • Juvenile records — Proceedings involving minors are confidential under W.Va. Code § 49-5-101 and § 49-5-103. Both court and law enforcement records related to juveniles are restricted and accessible only to specifically authorized parties.
  • Family court and domestic records — Certain sensitive domestic filings, including those involving custody of minor children, may have restricted components.
  • Medical and mental health records — Documents filed in involuntary mental hygiene proceedings are protected from routine disclosure.
  • Vital records — Birth, death, and marriage certificates are restricted under W.Va. Code § 16-5-27 for specified periods and are available only to authorized individuals.
  • Sealed records — Any record sealed by a court order is removed from public access until the court directs otherwise.
  • Active investigative files — Law enforcement records related to ongoing investigations may be withheld under the FOIA's law enforcement exemption.

Members of the public who are denied access to a record they believe should be public may seek legal review. The West Virginia FOIA requires that denials be made in writing and cite the specific statutory exemption relied upon.

Wyoming County Criminal Court Records

Criminal proceedings in Wyoming County move through two courts depending on the severity of the charge. The Magistrate Court handles misdemeanor trials, preliminary hearings in felony matters, and the issuance of arrest and search warrants. Felony cases, once bound over from the Magistrate Court to the grand jury, are prosecuted in the Circuit Court, which also hears felony and misdemeanor charges brought directly by grand jury indictment, as well as criminal appeals from the Magistrate Court.

The Circuit Clerk’s Office maintains all circuit-level criminal records, including indictments, orders, transcripts, sentencing documents, and judgment abstracts. One practical benefit worth knowing: the Circuit Clerk issues criminal background check certificates drawn from circuit court records at no cost to the requester.

For magistrate-level criminal records — including misdemeanor case filings, preliminary hearing records, and warrant information — direct your request to the Magistrate Clerk at 44 Cedar Street, Pineville.

Arrest-level information is maintained by the Wyoming County Sheriff’s Office, which provides law enforcement services to the county 24 hours a day:

Wyoming County Sheriff's Office

  • Address: P.O. Box 529, 24 Main Avenue, Pineville, WV 24874
  • Phone: (304) 732-8000, ext. 301
  • Fax: (304) 732-8712

The Sheriff’s Office handles approximately 4,000 calls annually and processes around 800 arrests per year. Booking records and recent arrest information can be requested from the Sheriff’s Office under West Virginia’s FOIA. The West Virginia Division of Corrections and Rehabilitation also maintains an offender search tool for individuals housed in state correctional facilities.

For online criminal case searches, both WVPASS (circuit court) and the Magistrate Case Record Search (magistrate court) are available at no charge and do not require pre-registration to search basic case index information.

Wyoming County Civil Court Records

Civil litigation in Wyoming County is divided between the Circuit Court and the Magistrate Court based on the dollar amount and nature of the dispute. The Circuit Court handles major civil suits — including personal injury claims, product liability actions, and debt collection cases above the magistrate’s jurisdictional threshold — as well as civil appeals from the Magistrate Court. The Magistrate Court functions as the county’s small claims forum, with civil jurisdiction over disputes valued at $20,000 or less under W.Va. Code § 50-2-1, as amended by HB 2761 in 2025 (raised from the previous $10,000 limit).

Magistrate Court civil case types include:

  • Money judgment claims up to $20,000
  • Landlord-tenant disputes and eviction (unlawful detainer) actions
  • Garnishment proceedings
  • Civil warrant applications
  • Preliminary hearings and emergency domestic violence petitions

The Magistrate Clerk — Jessica R. Daniels — maintains all magistrate civil records at 44 Cedar Street, Pineville, WV 24874, reachable at (304) 732-8000, ext. 218. The fax number for the Clerk’s Office is (304) 732-7247.

For circuit-level civil records, the Circuit Clerk’s Office at 24 Main Avenue processes document requests. The Circuit Clerk also handles the issuance of judgment abstracts recorded as liens against property, writs of execution against personal property, and wage garnishments (suggestee executions) arising from court-ordered civil judgments.

Civil case information for both courts is searchable online. Circuit court civil records are accessible through WVPASS, while magistrate civil case information is available through the Magistrate Case Record Search. Neither portal provides access to the underlying documents themselves — certified copies must be requested from the relevant clerk’s office.

Vital records related to family matters — marriage, divorce, birth, and death certificates — are controlled separately from court filings. Marriage licenses for Wyoming County are issued by the County Clerk, which also maintains historical birth, death, and marriage records dating back to 1850. For records from 1964 onward, certified copies are available from the West Virginia Vital Registration Office (VRO):

Birth records are restricted for 100 years from the date of birth; death and marriage records are restricted for 50 years. Request forms for birth certificates, death certificates, and marriage records are available directly from the DHHR website.

The County Clerk’s Office is located on the ground floor of the courthouse at the corner of Bank and Main Street in Pineville and is responsible for probating and recording wills, maintaining estate filings, and processing related documents.

Probate records available through the County Clerk include:

  • Wills and testamentary documents
  • Estate inventories and property appraisals

  • Phone: (304) 732-8000, ext. 242

The County Clerk’s office staff includes designated deputies handling probate matters — currently Morgan Abbott — who can assist with locating and copying estate documents. The County Clerk also maintains historical genealogical records, including birth, death, and marriage records dating to 1850, which are frequently useful in tracing heirship and establishing claims against an estate.

Court-supervised guardianship and conservatorship proceedings — such as those involving adult incapacity or contested minor guardianships — are handled at the Circuit Court level rather than administratively through the County Clerk. Forms for guardian appointments are available from the Circuit Clerk’s Office. For straightforward probate matters, many filings can be submitted directly to the County Clerk’s Office in person during regular business hours. Individuals managing complex estates or contesting a will should consult a West Virginia-licensed attorney, as staff at all clerk’s offices are prohibited from providing legal advice.
